Many unresolved disputes that concern construction and structural engineering can require the services of an expert witness for litigation. The court and litigating parties may require the expertise and testimony of an expert witness as an important, impartial specialist in certain matters who can render an educated and experienced opinion that can bear heavily on decisions within a case.

The person selected for an expert witness should be qualified to serve in this capacity. Any court or involved party would not want to trust the outcome of their case and the potential for huge amounts in damages to the word or judgements of a novice. What qualifications should you seek in an expert witness for litigation?

What Does It Take to Be an Expert Witness for Litigation?

According to the Federal Rule of Evidence 702, as stated by the Cornell University School of Law, “A witness who is qualified as an expert by knowledge, skill, experience, training, or education may testify in the form of an opinion or otherwise if:

  • the expert’s scientific, technical, or other specialized knowledge will help the trier of fact to understand the evidence or to determine a fact in issue;
  • the testimony is based on sufficient facts or data;
  • the testimony is the product of reliable principles and methods; and
  • the expert has reliably applied the principles and methods to the facts of the case.”

The presiding court shall always have the final approval as to whether or not an expert witness possesses the necessary qualifications to meet the above guidelines. Some courts may also require an expert witness to hold a specialist license in the state in which they are to testify.
